傭金要符合三個條件： 1、有合法真實憑證； 2、支付的對象必須是獨立的有權從事中介服務的納稅人或個人； 3、支付給個人的傭金，除另有規定者外不得超過服務金額的5%），可以計入銷售費用。 根據現行稅法規定，從事中介服務的單位或個人領取傭金時必須有合法真實的報銷憑證，支付的對象必須是獨立的有權從事中介服務的納稅人或個人（不含本企業雇員），支付給個人的傭金，除另有規定者外，不得超過服務金額的 5%。
不符合上述條件的傭金支出不得計入銷售費用稅前扣除。企業支付的傭金不得抵減相關銷售業務的銷售額和應納流轉稅（出口貨物傭金沖減當期出口業務收入），符合規定的傭金應計入銷售費用（或營業費用）并可在所得稅前扣除。
